If you disagree with any of these terms, you are prohibited from accessing this site. The materials contained in this Website are protected by copyright and trademark law.

2. Use License

Permission is granted to temporarily download one copy of the materials on WellView Health's Website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials;
• use the materials for any commercial purpose or for any public display;
• attempt to reverse engineer any software contained on WellView Health's Website;
• remove any copyright or other proprietary notations from the materials; or
• transfer the materials to another person or mirror the materials on any other server.

3. Who may use WellView Health

WellView Health is provided to healthcare practices and to the staff those practices authorize. A practice is responsible for the accounts it creates, for keeping its staff list current, and for removing access when a staff member leaves. Accounts are personal to the individual and must not be shared.

Patients do not create an account. A patient completes questionnaires through a private link tied to a single appointment, provided by the practice.

4. WellView Health does not provide medical advice

WellView Health is a tool for collecting and scoring questionnaires. It does not practice medicine, does not diagnose, and does not provide medical advice, treatment, or recommendations. Scores, categories, and results produced by the service are inputs for a qualified clinician to interpret, and are not a diagnosis and not a substitute for clinical judgment. All clinical decisions remain the responsibility of the practice and its clinicians.

If you are a patient using WellView Health, nothing in the service creates a clinician relationship between you and WellView Health or Elemodo. Discuss your results with your practice.

5. Questionnaires and scoring

WellView Health offers a library of widely used, publicly available screening instruments as a convenience, and practices can also build their own questionnaires. A practice is responsible for choosing which instruments are appropriate for its patients, for confirming that the wording and scoring of any instrument it uses are correct and current for its purposes, and for any licensing or attribution an instrument requires.

When a practice edits a questionnaire, responses already submitted are not changed. Each submitted response keeps a copy of the questionnaire as it was answered.

6. Alerts are not an emergency or monitoring service

WellView Health can flag a completed questionnaire for follow-up, show it in the practice's dashboard, and email a notification to an address the practice configures. These features are a convenience for practice staff. They are not monitored by WellView Health or Elemodo, they are not reviewed by any clinician on our side, and they are not an emergency, crisis, or after-hours monitoring service.

Alerts depend on the practice configuring them correctly, on questions being flagged, on email delivery, and on staff reviewing them during working hours, and they may be delayed or fail to arrive. A practice must not rely on WellView Health as its means of detecting or responding to a patient emergency, and must maintain its own clinical protocols for doing so.

7. Patient information and your responsibilities

Information a practice puts into WellView Health, including patient records and questionnaire responses, belongs to and is controlled by that practice. We host and process it on the practice's behalf, as described in our Privacy Policy.

Each practice is responsible for having a lawful basis to collect the information it collects, for providing its patients with any notice its jurisdiction requires, for the accuracy of the patient records it enters, and for handling patient requests about that information. Where the practice is a covered entity under HIPAA, WellView Health acts as its business associate. We offer every such practice a business associate agreement, and protected health information is handled in accordance with HIPAA and any such agreement in place with that practice.

Appointment links open questionnaires without a password. Practices should send them only to the correct patient and should not post them anywhere public.

8. Acceptable use

You agree not to use WellView Health to send unsolicited messages, to attempt to access another practice's data, to probe or interfere with the security or integrity of the service, to upload malicious code, or to use the service in violation of any applicable law. We may suspend access that threatens the security or availability of the service for others.

9. Disclaimer

All the materials on WellView Health's Website are provided "as is". WellView Health makes no warranties, expressed or implied, and hereby disclaims all other warranties. Furthermore, WellView Health does not make any representations concerning the accuracy or reliability of the use of the materials on its Website or otherwise relating to such materials or any sites linked to this Website.

10. Limitations

WellView Health and its suppliers will not be held accountable for any damages that arise from the use of, or inability to use, the materials on WellView Health's Website, even if WellView Health or an authorized representative of this Website has been notified, orally or in writing, of the possibility of such damage. Some jurisdictions do not allow limitations on implied warranties or limitations of liability for incidental damages, so these limitations may not apply to you.

11. Service availability and changes

We work to keep WellView Health available, but we do not guarantee uninterrupted service. Maintenance, provider outages, and faults can interrupt access. We may add, change, or remove features over time. Practices should keep their own records of anything they are required to retain, and should not treat WellView Health as their only copy of that information.

12. Revisions and Errata

The materials appearing on WellView Health's Website may include technical, typographical, or photographic errors. WellView Health does not warrant that any of the materials on this Website are accurate, complete, or current. WellView Health may change the materials contained on its Website at any time without notice, and does not make any commitment to update the materials.

WellView Health has not reviewed all of the sites linked to its Website and is not responsible for the contents of any such linked site. The presence of any link does not imply endorsement by WellView Health of the site. The use of any linked website is at the user's own risk.
